1. Agreement to Terms

By accessing the Que website at que.fyi, creating an account, or using any part of the Que platform (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

If you do not agree to these Terms in their entirety, you must not access or use the Service.

We may update these Terms from time to time to reflect changes in law, new features, or evolving business practices. When we do, we will revise the "Last updated" date at the top of this page and notify you by email at the address associated with your account at least 14 days before the changes take effect. Your continued use of Que after the updated Terms become effective constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service before they take effect.

These Terms are effective as of 28 February 2026.

2. Description of Service

Que is a scheduled AI prompt orchestration platform. It allows you to configure AI-powered tasks that execute on a schedule and deliver results to your inbox via email.

Que operates on a Bring Your Own Key (BYOK) model. You connect your own API keys from supported AI providers (such as Anthropic or OpenAI), configure prompts and schedules, and Que executes those prompts against your chosen provider on your behalf at the times you specify.

Que is an orchestration platform, not an AI provider. We do not generate AI responses ourselves, host AI models, or have any control over the outputs produced by third-party AI providers. Que's role is strictly limited to scheduling, executing, and delivering prompts using the AI services and credentials you configure. The quality, accuracy, completeness, and suitability of all AI-generated outputs are determined entirely by the third-party providers and the prompts you create.

You should not rely on AI-generated outputs delivered through Que for medical, legal, financial, or other professional advice without independent verification by a qualified professional.

3. Accounts

To use Que, you must create an account using a valid email address. You are responsible for maintaining the confidentiality and security of your login credentials, your account, and any API keys stored within it.

Age requirement. You must be at least 18 years of age to create an account and use Que. By creating an account, you represent and warrant that you meet this age requirement.

One person, one account. Each account is intended for use by a single individual. The exception is Team plan workspaces, where multiple named users may be invited as separate seats. Sharing login credentials for a single account between multiple people is not permitted.

Account security. You are solely responsible for all activity that occurs under your account. You must notify us immediately at support@que.fyi if you become aware of any unauthorised access to or use of your account.

We reserve the right to suspend or terminate any account that violates these Terms, is used fraudulently, or poses a security risk to the platform or other users.

4. Pricing and Payment

Que offers three plan tiers:

Paid plans (Pro and Team) are billed either monthly or annually, depending on the billing cycle you choose at the time of subscription. All prices are listed in US dollars (USD) and are exclusive of any applicable taxes, levies, or duties, which are your responsibility.

We will give at least 30 days notice before changing the price of any paid plan. Price changes will apply from the start of your next billing cycle after the notice period.

Refund policy. If you are on an annual plan and your usage has remained within free-tier limits, you may request a full refund within 14 days of your initial payment by contacting support@que.fyi. Monthly plans are not eligible for refunds. Partial-month or partial-period refunds are not provided. No refunds are given for unused portions of a billing period following cancellation or termination.

AI provider charges are separate. Que's subscription fees cover access to the Que platform only. You are solely responsible for any and all charges incurred from your AI provider (e.g. Anthropic or OpenAI API usage costs). Que does not control, monitor, or bill for those charges. See Section 5 for full details on API key cost responsibilities.

5. BYOK (Bring Your Own Key) — API Key Responsibilities

This is a critical section of these Terms. Please read it carefully.

5.1 How BYOK works. Que requires you to provide your own API keys from supported AI providers (currently Anthropic and OpenAI). You add these keys to your account settings, and Que uses them to execute your scheduled tasks by making API calls to your chosen provider on your behalf.

5.2 Key security. Your API keys are encrypted at rest using AES-256-GCM encryption. Keys are never logged in plaintext, never displayed after initial entry, and are never transmitted to any party other than the specific AI provider you have designated for each task. Despite these measures, no system is perfectly secure, and you acknowledge that you provide API keys at your own risk.

5.3 You are solely responsible for all API charges. You are solely and exclusively responsible for all charges, fees, and costs incurred on your API keys as a result of your use of Que, including but not limited to charges arising from:

5.4 Risk of multiple API calls. Que executes API calls on your behalf according to the schedules you configure. Due to the inherent nature of distributed computing systems, network retries, timeout recovery, error handling, and infrastructure failover, a single scheduled task may result in more than one API call to your AI provider. This is a known characteristic of distributed systems and is not unique to Que. By using the Service, you expressly acknowledge and accept this risk.

5.5 Budget caps strongly recommended. Que strongly recommends that you set spending limits, usage caps, or budget thresholds on your AI provider accounts at all times. Most providers (including Anthropic and OpenAI) offer built-in spending controls. Maintaining a small, controlled budget on your API key is the single most effective way to limit your exposure to unexpected charges. Que bears no responsibility whatsoever for unexpected, excess, duplicate, or erroneous API charges incurred on your API keys, regardless of the cause.

5.6 Provider terms of service. You must comply with the terms of service, acceptable use policies, and usage policies of your AI provider at all times when using their services through Que. Que is not responsible for any violation of provider terms arising from your prompts, configurations, or usage patterns. If your API key is suspended, revoked, or rate-limited by your provider, Que is not liable for any resulting disruption to your scheduled tasks.

The BYOK model and the associated allocation of API cost responsibility to the user is standard industry practice for credential-delegation and BYOK SaaS platforms, including services such as Zapier, Make (Integromat), TypingMind, and Helicone. Users of such platforms universally bear responsibility for all costs incurred through their own credentials.

We reserve the right to suspend or terminate your account immediately and without notice if we determine, at our reasonable discretion, that you are violating these acceptable use rules or using the Service in a manner that poses a risk to Que, its users, or its infrastructure.

7. Intellectual Property

Que's intellectual property. The Que platform, including its design, source code, user interface, branding, logos, documentation, and all related materials, is the intellectual property of Que and is protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

AI-generated output. AI-generated content created through your use of Que belongs to you, to the extent permitted by applicable law and subject to the terms and conditions of the AI provider whose model generated that output. We make no intellectual property claims over AI-generated content delivered through the Service. You are responsible for ensuring that your use of AI-generated content complies with applicable laws and the relevant provider's terms.

Your content. Your prompts, templates, configurations, and any other data you create on Que ("User Content") remain your intellectual property. By using Que, you grant us a limited, non-exclusive, royalty-free licence to process, store, and transmit your User Content solely for the purpose of operating and delivering the Service to you. This licence terminates when you delete your content or close your account.

Aggregated data. We may collect and use anonymised, aggregated usage data (such as feature popularity, task frequency patterns, and error rates) to analyse, improve, and develop the platform. This data cannot be used to identify you or reconstruct your User Content.

8. Data Handling

For full details on how we collect, store, process, and protect your data, please refer to our Privacy Policy, which forms part of these Terms.

In summary: we store your account information, task configurations, run history, and encrypted API keys. We use this data to operate, maintain, and improve the Service. We process task execution through your chosen AI providers exactly as you have configured.

We do not sell your personal data or usage data to third parties. We do not use your prompts, AI outputs, or User Content to train any models. We do not share your data with any party except as necessary to operate the Service (e.g. sending your prompts to the AI provider you have selected).

You may request deletion of your data at any time by contacting support@que.fyi or by closing your account through your account settings.

9. Third-Party Services

Que integrates with and relies on several third-party services to deliver the platform. These currently include, but are not limited to:

Que is not responsible for the availability, uptime, performance, accuracy, or security of any third-party service. Outages, deprecations, pricing changes, or policy changes by these providers may affect your ability to use Que, and Que shall not be liable for any such impact.

Each of these services is governed by its own terms of service and privacy policy, which you are responsible for reviewing and complying with independently. Your use of Que does not create any contractual relationship between you and any third-party service provider.

We may add, remove, or change third-party service integrations at any time. Where such changes materially affect the Service, we will endeavour to provide reasonable notice.

10. Service Availability

No uptime guarantee. Que does not guarantee any specific level of uptime, availability, or performance. The Service is provided on a commercially reasonable efforts basis. We aim to keep the platform available and reliable, but we do not offer a service level agreement (SLA).

Scheduled maintenance. We may perform scheduled maintenance that temporarily makes the Service unavailable. Where possible, we will provide advance notice of planned maintenance windows. Scheduled tasks that fall within a maintenance window may be delayed or skipped.

Unplanned downtime. The Service may be unavailable from time to time due to unplanned outages, infrastructure failures, third-party service disruptions, security incidents, or other circumstances beyond our reasonable control. Que shall not be liable for any loss, damage, or inconvenience arising from any period of unavailability.

Force majeure. Que shall not be liable for any failure or delay in performing its obligations where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, terrorism, power failures, internet outages, or third-party service failures.

11. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by applicable law, Que expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

Without limiting the foregoing, Que does not warrant that:

Specific disclaimer of liability for API costs. To the maximum extent permitted by law, Que and its owners, officers, directors, employees, contractors, agents, and affiliates (collectively, the "Que Parties") shall not be liable for any charges, fees, or costs incurred on your API keys, including but not limited to charges arising from:

General limitation. To the maximum extent permitted by law, the Que Parties shall not be liable for:

Exclusion of consequential damages. To the maximum extent permitted by applicable law, in no event shall the Que Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or damages for loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability (contract, tort, strict liability, or otherwise), and even if the Que Parties have been advised of the possibility of such damages.

Liability cap. In any event, the total cumulative liability of the Que Parties to you for all claims arising from or related to these Terms or your use of the Service shall not exceed the total amount you have actually paid to Que in the twelve (12) months immediately preceding the event giving rise to the claim. If you are on a free plan, or if you have not made any payments to Que, the maximum aggregate liability of the Que Parties is zero dollars ($0).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Que Parties from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

This indemnification obligation survives the termination of these Terms and your use of the Service.

13. Termination

You may close your account at any time through your account settings or by contacting support@que.fyi.

When your account is terminated (whether by you or by us):

Que may terminate or suspend your account, with or without notice, for:

The following provisions survive termination of these Terms: Sections 5 (BYOK), 7 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and any other provisions that by their nature should survive.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of law provisions.

Informal resolution. If a dispute arises out of or in connection with these Terms, both parties agree to first attempt to resolve the matter through good-faith negotiation by contacting the other party in writing.

Mediation. If the dispute cannot be resolved through negotiation within 30 days, both parties agree to attempt mediation administered by a mutually agreed mediator before pursuing formal legal proceedings. The costs of mediation shall be shared equally between the parties.

Jurisdiction. If mediation is unsuccessful or if either party elects not to participate in mediation, any legal proceedings shall be brought exclusively in the courts of the State of New South Wales, Australia, and both parties irrevocably submit to the jurisdiction of those courts.

Nothing in this section prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

16. Entire Agreement

These Terms, together with our Privacy Policy and any plan-specific terms presented at the time of subscription, constitute the entire agreement between you and Que with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Que regarding the Service.

No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorised representative of Que. A failure or delay by Que in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.

18. Referral Program

Que operates a refer-a-friend ("RAF") program that allows existing users to invite others to the platform. The following terms apply:

18.1 How it works. Each Que user receives a unique referral link. When a new user signs up through your referral link and becomes active (defined below), you earn a one-time $3 USD discount applied to your next billing cycle payment.

18.2 Active referral. A referral is considered "active" when the referred user has created an account and completed at least one task run on the platform, regardless of whether the referred user is on a free or paid plan.

18.3 Monthly limits. You may earn referral discounts for up to 3 active referrals per billing month, for a maximum discount of $9 USD per billing cycle. Referral discounts cannot exceed the total amount of your subscription payment for that billing cycle.

18.4 One-time discount. Each active referral earns a single $3 discount applied to your next payment only. Referral discounts are not recurring — they do not carry forward as an ongoing reduction to your subscription price. For example, if you refer 3 active users in one month, you receive a $9 discount on your next payment, after which your subscription returns to its standard price.

18.5 Annual plans. If you are on an annual billing cycle, referral discounts are applied to your next annual payment. The maximum discount of $9 per billing month still applies — referrals earned across different months within the same annual cycle may each contribute up to $9 toward the next annual payment.

18.6 Free plan users. Users on the Free plan may participate in the referral program. Referral credits are held and applied if and when the user upgrades to a paid plan.

18.7 Abuse and fraud. Que reserves the right to revoke referral discounts, suspend referral privileges, or terminate accounts if we determine, at our reasonable discretion, that the referral program is being abused. This includes but is not limited to creating fake accounts, self-referrals, or any scheme designed to exploit the program for unearned discounts.

18.8 Modification or termination. We may modify the terms of the referral program or discontinue it at any time. Changes will be communicated via email or through the platform. Referral discounts earned before a program change will be honoured.
